Federal District Court

After the Appeals Council, the final appeal is to Federal District Court. Although it is possible for your claim to be approved at this level, it is uncommon and takes 1-3 years for a decision to be made. It is strongly recommended that if your claim gets this far, you both appeal to the Federal District Court and start a brand new claim with Social Security. This gives you a greater chance of having your disability claim seriously considered.

If you have a disability representative, he or she will discuss your options with you and will handle the appeal. If you prefer to submit the appeal without help, contact Social Security for more information.
